  • hello everyone. My question is how long does it take for someone to file for bankruptcy the second time?

    if someone had filed in 2003 for instance how long would it take to refile? I gave this example because I have heard that the laws have changed in recent years. Also, can anyone give me some examples of the side effects this would cause by filing for bankruptcy a second time and is it much more difficult when you file again than the first time? Thanks a bunch for your help.

    I may have to file Bankruptcy (chapter 7) for a second time this year. I wanted to know if it’s okay to use the same lawyer I used for the first BK. Does it matter if you use the same lawyer twice for a second BK? Would it raise a Red Flag or should I be safe and use a different lawyer?
    I had to file a BK in 2000 because of my ex-husband. I was lied to and misled on a home purchase for someone else which I now owe over 100K. Perhaps, people should not JUDGE others since they do not know some the details. If people have nothing positive and/or helpful to say, they should not say anything.
    Yes, I know some about the new BK laws. And sorry if I confused anyone when I said a second time this year. I just meant the second time I’d have to file would be this year. I just wanted to know if it’s wise to use the same lawyer. I did read some where (don’t remember where) that you should not use the same lawyer if you have to file BK a second time.

    I made a mistake with my debt 2 years ago, im seriously considering bankruptcy. Im just so scared im going to have to explain everything to the judge myself. Im going to hire a lawyer to do the bankruptcy for me but im such a shy person and i clam up when im under pressure.

    Does the judges ask you when you first started getting the debt?
    Also does the judge ask you how come you have an unbelievable.

    SO my wife and I purchased our first home in 2006, and shortly before we had our daughter. Due to a lot of time off from work due to complications in my wife’s pregnancy, and me losing my job we fell behind on the mortgage. We struggled with paying what we could until the economy got really bad in 2008 and we couldn’t afford to even pay the morgage at some. Then in June of 2008 we lost the house to forclosure… Now my credit score is in the low 500’s and I can’t get approved for ANYTHING. I know from researching that both foreclosure and bankruptcy stay on your credit for 7 years, but which is better to deal with??

    About 3 months ago I had to have a life saving surgery and it price me a total of ,000. I was not insured because my job requires me to be working there for 90 days before I am insured.
    I am now ,000 in debt, and I don’t know what to do. The hospital was THREATENING to sue me, and take away my car and everything I own. The debt collectors were harrassing me, telling me I was going to be homeless on the street if I didn’t pay. So I put it on my credit card.

    Bad mistake, according to my lawyer. He said that if I file for bankruptcy so soon before that American Express is going to sue me and contend that I never had some intentions of paying back the debt in the first place and that I may most likely lose against them. He said to wait 6-12 months before doing it. Does this sound right?
    Meanwhile I am stuck with 00 a month MINIMUM payments which I can’t afford. In addition to my current job I have taken another job to just meet the minimum payments and have enough for necessities.
    Help, please. Advice?
    No they really were threatening me. I didn’t know anything about secured or unsecured debt, and did not know that hospital bills are unsecured debt and they can not place some liens on the things I own.

    How do I do this. I am 24 and I used to have the best credit score. some in 1 day I lost my job, and I had just moved out on my own. SO for about 2 years I am trying to get the credits to stop calling me and explain to them if I had the money I would pay them and wouldnt be in debt in the first place. I am always on time and monthly with my insurance, car payment, rent and utilities. I feel like these are most important. But Im scared I am gonna go to Jail or something :( I cant afford to get my wages garnished either. And I tried to consolidate but alot of them wont take it and The ones that may I pay out about 0 a month for 3 bills and I cant afford it anymore!! I dont want bad credit but i always feel so stress out.. I owe about ,000 in Credit Card Debt. ANother 00 to veriaon bill and about 0 to the hospital.
    Again my car is always on time and that I merely owe about 00. But i may never be willing and able to make enough to satisfy some my creditors.
    But that is ontop of some my other bills so lets say Im about 15,000 in debt. I forgot to mention I owe the bank another 0 to for my checking account. HELP!!

    My father passed away 6 months ago. He was merely 48, my mother is 52. he cannot collect on his SS. And they had filed bankruptcy 2 years ago. First the bankruptcy lawyers said they would lower his debt payments, since my father is deceased. Now they are saying that they can wipe his debt away yet he may have to pay off my fathers’ debt. Can anyone elaborate as to why they would clear his debt but still make his pay for his?

    I filed bankruptcy and was discharged 1/06. I described a car that was totaled, including the name of the lienholder. They did nothing-didn’t pick up the car or respond in some way. I have someone willing to give me a few hundred dollars for the salvage value. Can I sell it? Do I have to get the lienholder off the title first? If so, how do I do that?

    My bankruptcy was discharged and closed in March of 2008. A couple months ago I found out I had a creditor still requesting money that I didn’t know about, and was not present on my credit report when I first filed. I was wondering if I could reopen my chapter 7 that was discharged and closed (in Illinois)and put this creditor in it. I filed myself without an attorney, so I didn’t know if this was possible.
