What does personal/business bankruptcy protect you from as far as whats under your name and assets in the State of Virginia? No debt just need to get out of lease due to lack of business.

Separation, Bankruptcy and Credit Card Debt?
My husband of 29 years recently walked out on me and our 3 girls. I’ve been awarded spousal support and child support through the courts. 0 spousal, and 500.00 Child support ( that ends in 2 years )
Ever since he left, Oct 1st I have fallen behind on some of my bills, but mostly my 2 Credit cards which are solely in my name. These are in my name because he had a business bankruptcy about 5 years ago, and was not willing and able to obtain some credit.These cards are both maxed out to a total of nearly 10 thousand dollars, and the phone calls have just begun.I try my best to keep my payments up, but I’m not even meeting the minimum.
Yesterday I received a call from a credit bureau over my Sears charge card and found out that they are charging me an 8.00 a month for an Over Limit Amount !
I phoned them and asked them to stop those extra charges and of course they told me no . They also told me to go into bankruptcy. before 2 days of researching the net, and making phone calls, I find that I could lose my home if I do this?? I am quite mystified at the whole process and wondered if you had some sound advice for me? I have just been in touch with a debt consolidation place, but they said that I would have to make payments of 0.00 each month for 5 years..
That’s over 3,000 more than i owe right now, and if I had an extra 250.00 I’d be making my credit cards payment with that. I am 53 years of age, have been out of the work force for 16 years ever since we got custody of his grand daughter.
I am also leery of leaving my eldest daughter home alone, he is Down syndrome, and we use wood heat to keep the place warm. I am joint owner of a mobile home with my ex husband, and the 3 girls live here with me. The mobile is paid off now. I cannot risk losing the roof over our heads by declaring bankruptcy, do you see some way out for me? Should I declare bankruptcy, Debt Consolidation or keep plugging uselessly away?

Not business bankruptcy, personal bankruptcy. If a married couple were filing, would they have to file seperately or together?

How does the Business bankruptcy process for ch 7 work?
I own a bridal store that I bought in 2006, it has not profited since. I have not received pay roll since I purchased the store. Now that the economy has gotten so bad and with debt to creditor and suppliers, I am thinking of claiming bankruptcy. It is a sole prop. and I am planning also to claim personal bankruptcy. I found out my step mom has cancer again and I’ve been so stressed with the business and the cancer issue, that I would like to claim bankruptcy.
What is the process in ch 7 bankruptcy? mainly the trustee part. Does it mean that I no longer need to open the business and someone else may be at the store selling off some our gowns and basically closing the store and paying off our debt? what is the time line for that? Also, I feel so embarrassed that I can’t pay off my debt in the business, do I contact my creditors and suppliers or does someone else contact them?

Business Bankruptcy or other options…HELP!?
Ok. the best friend of mine recently took out a business loan to bulid a self storage facility. Well in the process no banks would finance his, so he got a loan from a personal lender. However the interest on this loan is 11%! he had reserve money to get his through slow times. But now he has spent 90% of it to keep the business open, because he is having a hard time getting occupants. Basically no income with a huge morgtage. I am very worried for his. he thinks he is going to have to file bankruptcy. But in the event of that he may loose everything and destroy his credit! Please if anyone has some comments of what he can do to keep the business going for just a few more months so he can have a little more time to fill it up. If he could get customers, everything would be ok. Also some ideas on advertisement would help, or anything that might take business! Thanks!

Filing business bankruptcy for an LLC
I am trying to collect info on filling bankruptcy for an LLC- just oppened 7 months ago and have been willing and able to keep upfloat until now but no longer have the funds to pay the high rent, business loans or even employee payroll.
What options do I have? may a bankruptcy for an LLC kill my personal credit? Am I correct that personal belongings (such as my home) are safe?

Curious question. If my Corporation were to get a loan for say 0k and in a few yrs went bankrupt. Would that bankrupcy hurt my chances of later on getting a personal loan or another business loan?
