I have purchased a mobile home in the last year. The company itemized that certain things go along with the purchase, such as underpinning, appliances, and a new A/C unit. We have the paper work stating this. It has been over a year and we haven’t recieved an A/C unit or some the appliances that were promised. The company that I bought it from has either went into bankruptcy or are in the process. Can I take them to small claims court to recover these items?

Taking someone to small claims court who has filed bankruptcy?

I would visit http://diylegalinfo.com/bankruptcy_Links.html/ They have a lot of good information on bankruptcy questions.

I wouldn’t even go to court, you got screwed. Bankruptcy trumps small claim court judgments and it will surely not be a priority.
The system is far from perfect…

you can, but you will not be classed as priority so even if you do get a judgement you will probably never see your money
put it down to bad experience and move on

Sorry, you are going to be way down on the list of creditors. I would still go to court and get the judgment just in case but chances are slim.
