I am a North Carolina Resident. I filed Chapter 7 bankruptcy 2 years ago (September) and my mortgage was included in my bankruptcy. However, I continued to stay in my home and pay my mortgage on time every month. I have just been cut down to part time hours at work, so I just missed my first mortgage payment on August 1. How long may foreclosure take, and what is the timeline?

You say the mortgage was included in the bankruptcy. Did you reaffirm the debt? Meaning did you sign an agreement between you and the mortgage company that you would continue making payments and they would allow you to keep the house? If you signed the reaffirmation agreement, you are still responsible for the debt. After 3 missed payments (in most states) the mortgage company can proceed with the foreclosure process. If you are wanting to stay in the house you need to catch up on the mortgage. If it looks like you can’t catch up, contact an attorney to discuss a Chapter 13. Good luck.
